Q: If a police officer asks me if I've been drinking, how do I answer?
A: You are not required to say anything incriminating about yourself. Our best advice is to ask for a lawyer before answering any further questions. Please note however: they do not have the legal obligation to provide you with any attorney unless they arrest you. Nevertheless, that doesn't mean you can't ask for one.

Q: Should I take the Alabama Field Sobriety Test?
A: NO! The tests are highly subjective and we would attack them as being unreliable at court anyway. But there's no point in giving the prosecution any added ammunition to work with if you can avoid it up front.

Q: How much does an Alabama DUI attorney cost?
A: A competent and seasoned criminal defense attorney with experience focusing on drunk driving cases will cost more than a lawyer who lacks that particular background. The difference in cost is similar to that between two physicians when one is a general practitioner and the other is a surgeon. But to stick with the metaphor, if you had to go into surgery, which would you choose between the two? The specific fee really depends on the circumstances. It can range from $500 to $15,000. At the Eversole Law Firm, we go to great lengths to see that even those with limited funds can afford our services. We have fixed fees, accept Visa, Mastercard and Discover, and are open to various kinds of payment arrangements.

Q: Can I refuse an Alabama Breath Test?
A: The state of Alabama has what is called an "Implied Consent Law." This effectively means that if you operate a motor vehicle, you automatically consent to a breath test should you be pulled over and asked to do so by a police officer. So in short, the answer is no, you cannot LEGALLY refuse a Breath Test. The consequences of refusing are automatic suspension of your license for 90 days, and the refusal will go into the police report and be used against you in court. HOWEVER... it is the opinion of our founder, Steven Eversole, that he would personally never take a Breath Test, especially if his attorney was not present. There are administrative legal procedures to turn over the license suspension as a result of your refusal. Nevertheless, in the end, it is your choice. If you do take the Breath Test, take solace in knowing that we have a long track record of successfully challenging such results in court and getting back your drivers license.

Q: Can I REALLY Win An Alabama DUI Case?
A: YES! We wouldn't be in this business if it weren't true. We would have hung up our hats long ago and gone into tax law.
